Continental's Rules Don't Apply


Continental's flight was delayed leaving Killeen due to a mechanical problem on the inbound flight. As a result, my son and granddaughter would miss their connection from Houston to Ontario, CA. No coach seats were available on later Continental flights out of Houston for two days. Continental charged an additional $638.00 (for which I paid) for them to fly the same evening out of Houston on a later flight in first class.

By doing this, Continental refused to abide by their own Contract of Carriage which states: E) Schedule Irregularity 1) Liability - Except to the extent provided in this Rule and the Warsaw and/or Montreal Conventions, CO shall not be liable for any Schedule Irregularity. 2) Delay, Misconnection or Cancellation a) When a Passengers ticket is affected because of a Schedule Irregularity caused by CO, CO will take the following measures: (i) Transport the Passenger on its own flights, subject to availability, to the Destination, next Stopover point, or transfer point shown on its portion of the Ticket, without Stopover in the same class of service, at no additional cost to the Passenger, provided that a Passenger who paid a Coach fare may only be transported on a flight in First Class or Business First Class Service subject to seat availability and if such flight will provide an earlier arrival than COs next flight on which coach space is available.

In short, Continental extorted an additional $638 to transport my kids on a later flight due to their problem.
